By accessing or using the Fitpid platform ("Platform", "Service", "we", or "our"), you ("User", "you", or "your") agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you should not use the Platform.

These Terms constitute a legally binding agreement between you and Fitpid.

2. Service Description

Fitpid is a digital sports management platform that connects:

• Athletes: Users seeking to improve their sports performance
• Independent Coaches: Autonomous physical education professionals
• Sports Agencies: Companies managing teams of coaches
• Health Professionals: Nutritionists, physiotherapists, doctors, and psychologists

The Platform offers training planning, performance analysis, health management, sports device integration, and facilitates professional connections.

3. Eligibility

To use the Platform, you must:

• Be at least 18 years old
• Be legally capable of entering into binding contracts
• Not be prohibited from using the Service by applicable law
• Provide true, accurate, and complete information during registration

Professionals: Coaches and health professionals must possess valid registrations with their respective professional councils.

4. Registration and Account

4.1. Account Creation

You must create an account to access the Platform. It is your responsibility to:

• Maintain the confidentiality of your access credentials
• Notify us immediately of any unauthorized use of your account
• Keep your registration information up to date
• Not share your account with third parties

4.2. Multiple Profiles

A user may have multiple active profiles (e.g., athlete + nutritionist). All individual users automatically receive an ATHLETE profile upon registration.

4.3. Professional Verification

Professional profiles (coaches, health professionals) are subject to credential verification. Providing false information will result in account suspension or termination.

5. Acceptable Use of the Platform

5.1. Permitted Conduct

You may use the Platform to:

• Manage workouts, health plans, and sports performance
• Connect with qualified professionals
• Share sports content with your community (Trends)
• Access coupons and benefits from partners

5.2. Prohibited Conduct

You MAY NOT:

• Violate applicable laws or regulations
• Use the Platform for fraudulent or deceptive purposes
• Impersonate another person or entity
• Interfere with Platform operation (hacking, DDoS attacks, etc.)
• Collect data from other users without consent
• Post offensive, discriminatory, violent, or illegal content
• Engage in spam or unsolicited marketing
• Use bots, scripts, or automation without authorization
• Provide medical advice without proper professional qualifications

6. Professional Relationships

6.1. Connections Between Athletes and Professionals

Fitpid facilitates professional connections but IS NOT:

• A provider of training or health services
• Responsible for the quality or results of services provided by professionals
• A party to contracts or disputes between users

6.2. Professional Responsibilities

Professionals are responsible for:

• Maintaining valid and updated professional registrations
• Complying with ethical codes of their respective professions
• Obtaining informed consent before providing services
• Respecting professional competence boundaries
• Maintaining confidentiality of sensitive information

6.3. Coach/Agency Exclusivity

7. Payments and Subscriptions

7.1. Payment Plans

The Platform offers free and paid plans. By subscribing to a paid plan, you agree to:

• Pay all applicable fees
• Provide valid payment information
• Authorize recurring charges (if applicable)

7.2. Cancellation and Refunds

You may cancel your subscription at any time. Refunds are processed according to our cancellation policy, which varies by subscribed plan.

7.3. Transactions Between Users

Direct payments between athletes and professionals are the sole responsibility of the parties involved. Fitpid may facilitate transactions through payment gateways but does not guarantee execution or service quality.

8. Intellectual Property

8.1. Fitpid Content

All Platform content (code, design, texts, logos, trademarks) is owned by Fitpid or its licensors. You MAY NOT:

• Copy, modify, or distribute our code or design
• Use our trademarks without express authorization
• Reverse engineer the Platform

8.2. User Content

By posting content on the Platform (posts, photos, workouts), you:

• Retain ownership of your content
• Grant Fitpid a non-exclusive license to host, display, and distribute your content
• Warrant that you have rights to the posted content
• Are responsible for third-party copyright violations

9. Privacy and Data Protection

The use of your personal data is governed by our Privacy Policy, which is an integral part of these Terms. By accepting these Terms, you also accept our Privacy Policy.

Health Data: We process sensitive health data in compliance with applicable data protection laws. You expressly consent to the processing of such data for the purposes described in the Privacy Policy.

The Platform is provided "as is" and "as available". We do not guarantee:

• Uninterrupted or error-free availability
• Specific training or performance results
• Quality of services provided by professionals
• Compatibility with all devices or browsers

Under no circumstances shall Fitpid be liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of data, revenue, or profits
• Business interruption
• Physical injuries resulting from workouts or third-party guidance

11. Account Suspension and Termination

11.1. By You

You may terminate your account at any time through Platform settings.

11.2. By Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms
• There is suspicion of fraud or illegal use
• It is necessary to comply with legal obligations
• There is prolonged inactivity (more than 2 years)

12. Terms Modifications

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through a notice on the Platform. Continued use after changes constitutes acceptance of the new Terms.

If you do not agree with the modifications, you must terminate your account.
